ATTORNEY PROFILE
BRADLEY D. MYERSON ESQ.
Bradley D. Myerson has been defending drinking
drivers since 1982. He has been an instructor at
continuing legal education programs for attorneys
learning D.W.I. defense techniques, and is the author of
several articles on this topic. His recent D.W.I. cases
of note include:

State v. Morgen 7 Vt.Tr.Ct.Rptr. 194 (2003) -
Where 2 breath test results taken minutes apart
varied by greater than 10%, results were inaccurate;
judgment for operator in Civil Suspension proceeding
notwithstanding breath test result of .20%;

State v. Sargent 4 Vt.Tr.Ct.Rptr. 67 (1999) -
Exclusion of evidence of driver’s refusal to provide
breath sample in criminal case and judgment for
driver in Civil Suspension case where her mouth
injuries rendered incapable of providing adequate
breath sample;

State v. C.F. - Exclusion of breath test results
from criminal case and judgment for driver in Civil
Suspension matter where police failed to disclose
that video cameras in processing room were actually
turned off.

State v. R.B. - Judgment for driver in Civil
Suspension case where Datamaster machine used to
analyze breath test results was using simulator
solution which had not been replaced prior to
manufacturer’s expiration date.
Mr.
Myerson is a member of the Vermont and National
Associations of Criminal Defense Lawyers. He is
currently serving his third term as a member of the
Vermont Judicial Nominating Board. He is a graduate of
Syracuse University and the New England School of Law.
