Under certain circumstances, a person may be able to have their criminal conviction or charge expunged. When a person's record is expunged, they can legally say they have NEVER been arrested, charged or convicted of the crime expunged.
In Vermont, expungement is only available for qualifying crimes.
What crimes qualify?
Most misdemeanors and a few felony offenses qualify. Crimes such as a DUI, violent offenses and most felonies are not eligible.
Is there a waiting period to seek expungement?
It all depends on whether the State's Attorney agrees with the expungement request or not. If the State's Attorney does not object, then any qualifying crime can be expunged. If the State's Attorney does not agree to sign off on the expungement request, there are waiting periods depending on when convictions occurred and sentences were fully completed.
What does it cost?
There is a $90 court filing fee when a petition is filed. Fee waivers are available.
